I. General Terms and Conditions

1 Basic provisions

  1. The following General Terms and Conditions apply to all contracts that you conclude with HD Solutions GmbH as provider via the website www.esimony.com, the online shop or the “eSIMony” mobile app. The contracting party remains HD Solutions GmbH in each case. Unless otherwise agreed, we object to the inclusion of any terms and conditions used by you.
  2. Consumers within the meaning of the following provisions are natural persons who enter into a legal transaction for purposes that are predominantly outside their trade, business or profession. Entrepreneurs are natural or legal persons or partnerships with legal capacity who, when entering into a legal transaction, act in the exercise of their trade, business or profession.

2 Conclusion of the contract

  1. The subject matter of the contract is the sale of goods, eSIM, or services, top-up.
  2. The eSIM connectivity is technically provided via a network, mobile communications or eSIM provider partner. The provision may include, in particular, QR codes, installation data, activation information, status information, usage data and top-ups.
  3. By placing a product on our website, in our online shop or in the app, we make a binding offer to conclude a contract. The contractual terms are stated in the product description.
  4. The contract is concluded as follows:
  • Place the goods you wish to purchase in the “shopping cart”. You can access the “shopping cart” via the corresponding icon in the navigation bar or in the app and make changes there at any time.
  • During the ordering process, you enter your personal data and the information required for order and payment. Order and payment processing is carried out via Shopify or via Shopify Checkout and the payment service providers integrated there. Finally, all order details are displayed again on the order overview page.

If you use an instant payment system, for example PayPal or instant bank transfer, you will either be taken to the order overview page in our online shop, in the app or in Shopify Checkout, or you will first be redirected to the website of the provider of the instant payment system. You enter your details there. Finally, you will be redirected back to our online shop, the app or Shopify Checkout.

At this stage, you have the opportunity to review all data again, make changes or cancel the purchase before submitting the order. By submitting the order, the contract is legally concluded.

  1. The processing of the order and transmission of all required data is partly automated. Please therefore ensure that the email address you provide is correct.
  2. Where legally available, you may also declare withdrawal from the contract via the native withdrawal function in the app using the button “Withdraw from contract”. Further details are set out in the cancellation policy.

2a Travel groups and fellow travelers

  1. Within the “eSIMony” mobile app, you may use the “Travel groups” feature to purchase eSIMs not only for yourself but also for fellow travelers.
  2. If you enter fellow travelers’ details, you act as the purchaser and contractual partner for the respective order. Fellow travelers do not become our contractual partners solely because their details are entered or because activation information is sent to them.
  3. Cancellation, withdrawal and refunds may be requested only by you as the purchaser and are processed through your order. Fellow travelers have no independent cancellation or refund right against us in relation to that order.
  4. If an order or an individual eSIM purchased for a fellow traveler is canceled, if the contract is withdrawn from or if a refund is granted, the affected eSIM may be invalidated, marked as canceled and no longer usable, including for the fellow traveler.
  5. Depending on the selected function, you may either manage the eSIMs purchased for fellow travelers yourself or the respective fellow traveler may manage the assigned eSIM themselves.
  6. You are responsible for entering the fellow travelers’ names and email addresses correctly and for ensuring that you are entitled to provide this data for the purpose of purchasing and delivering the respective eSIM.
  7. Activation information, in particular QR codes and installation data, may be sent to the email address you provide for the respective fellow traveler. Delivery to the email address provided by you is deemed delivery to the recipient designated by you.
  8. The device requirements and product conditions shown in the respective offer apply also where an eSIM is purchased for a fellow traveler.

3 eSIMiles bonus program, discount codes and points

  1. Separate terms and conditions apply to the “eSIMiles” bonus points and loyalty program. These are available at: https://www.esimony.com/pages/esimiles-terms-and-conditions.
  2. If you redeem a discount code as part of eSIMiles, this discount code reduces the purchase price shown during the ordering process in accordance with the applicable redemption terms.
  3. In the event of cancellation, refund or chargeback of a purchase, the points credited for that purchase may be reversed in accordance with the separate eSIMiles terms and conditions.

4 Right of retention, retention of title

  1. You may exercise a right of retention only if it relates to claims arising from the same contractual relationship.
  2. All goods remain our property until the full purchase price has been paid.

5 Warranty

  1. The statutory warranty rights apply.
  2. As a consumer, you are requested to check the order promptly and inform us of any complaints as soon as possible. Failure to do so has no effect on your statutory warranty rights.

6 Place of performance, place of jurisdiction, contract language

  1. All legal relationships between us and the buyer are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods, CISG.
  2. For all disputes arising from the contractual relationship, Berlin shall be the exclusive place of jurisdiction if the buyer is a merchant, a legal entity under public law or a special fund under public law.
  3. The contract language is German. This English version is provided for convenience. In the event of discrepancies, the German version prevails, unless mandatory law provides otherwise.
  4. If individual contractual provisions are or become invalid in whole or in part, the remainder of the contract remains valid. In the event of such invalidity, the contracting parties shall agree on a legally valid replacement provision that comes as close as possible to the invalid provision in terms of content and economic purpose. The same applies if there is a gap in the contract.

3 Prices and payment terms

  1. The prices shown are total prices. They include all price components, including applicable taxes.
  2. All available payment methods are shown in our online shop, in the app or in Shopify Checkout.
  3. Unless otherwise stated for the individual payment methods, payment under the concluded contract is due immediately.
  4. Order and payment processing is carried out via Shopify or via the payment service providers integrated into Shopify Checkout.
  5. A discount code redeemed as part of the eSIMiles bonus program will be taken into account during the ordering process and will reduce the displayed purchase price in accordance with the applicable redemption terms.

4 Delivery terms

  1. The delivery terms can be found under a correspondingly labeled button in our online shop, in the app or in the respective offer.
  2. If you use the “Travel groups” feature, activation information for an eSIM may be sent to the email address you provide for the respective fellow traveler.

5 Consumer dispute resolution

The former European Online Dispute Resolution platform, ODR platform, was discontinued on 20 July 2025. A link to this platform is therefore no longer provided.

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board, unless there is a statutory obligation to do so.
